Terms of Service

1. What RabitX offers

Depending on where you live, the Services can include:

• Crypto ramps: buying crypto with local payment methods, selling crypto for local currency and swapping one token for another.
• Gift cards, top-ups and eSIMs: bought with crypto through our partner Cryptorefills, which sells and delivers them as merchant of record.
• Hardware wallet shop: SafePal hardware wallets and Cryptotag seed phrase backups, sold and shipped by us.
• Business integrations: a redirect URL, embeddable widget and JavaScript SDK that let other businesses offer our ramps to their users, under a separate written agreement.

Not every service, token, payment method or country is available at all times. We may add, change, pause or withdraw any part of the Services, for example to meet legal requirements or to protect users.

2. Who can use RabitX

To use the Services you must:

• be at least 18 years old and able to enter into a binding contract;
• use the Services only for yourself, or for a business you are authorised to act for;
• not live in, or act for anyone in, a country or region where the Services are not offered or where using them would be illegal;
• not be named on any sanctions list maintained by India, the United Nations, the European Union, the United Kingdom or the United States; and
• complete identity verification when we ask for it, as described in our AML / KYC Policy.

3. Your account and security

Some Services need a RabitX account. You agree to give accurate, current information, keep it up to date, and keep your login details private. You are responsible for everything done through your account until you tell us it has been compromised.

RabitX is non-custodial: crypto you buy is sent to a wallet address you choose, and we never hold it for you. You alone control your wallet, private keys and seed phrase. We cannot recover them, reverse a transfer or move funds out of your wallet.

4. Buying, selling and swapping crypto

Before you confirm an order we show you a quote with the rate, our platform fee, the network fee and any payment or payout fee. A quote is valid only for the time shown on it; if it expires, you will get a new quote at the current market rate.

Once you confirm an order and we have received your payment or crypto, the order cannot be cancelled. Blockchain transactions are final: we cannot reverse crypto sent to the address you entered, so check the address and network carefully. Crypto sent to a wrong address or on an unsupported network is usually lost permanently.

We may delay, hold or refuse an order if we need to verify your identity or the source of funds, if a payment looks fraudulent or is reversed, or if the law requires it. If we cannot complete an order, we return your payment as set out in our Refund & Returns Policy.

Prices of crypto assets change quickly and can fall to zero. Please read our Risk Disclosure before you trade.

5. Gift cards, top-ups and eSIMs

Gift cards, mobile top-ups and eSIMs are sold, delivered and supported by Cryptorefills, which is the merchant of record. When you place one of these orders you buy from Cryptorefills, and its terms of service apply to the purchase in addition to these Terms.

Each brand sets its own rules for where and how its cards can be used. Delivered gift card codes cannot be returned or exchanged. Refunds for unpaid, underpaid or failed orders are handled by Cryptorefills as described in our Refund & Returns Policy.

6. Hardware wallet shop

Products in the shop are sold by RabitX Technologies Private Limited. Prices are shown in Indian rupees (INR) and include applicable taxes unless stated otherwise. You can pay with USDT, BTC, ETH or a Visa or Mastercard card.

Your order is an offer to buy. A contract is formed when we email you to confirm that your order has been accepted. We may refuse or cancel an order, and refund you in full, if a product is out of stock, a price or description was clearly wrong, or the order looks fraudulent.

Promotional codes are valid only for the period and products stated, cannot be exchanged for cash, and are limited to one code per order.

Delivery is covered by our Shipping Policy, and returns, replacements and refunds by our Refund & Returns Policy. Manufacturer warranties are provided by SafePal (Bittech Group Limited) and Cryptotag, and we help you make a claim.

For your security, always set up a new hardware wallet yourself, generate a fresh seed phrase, and never use a device that arrives with a seed phrase already written down or set up.

7. Fees and taxes

Our fees are shown in each quote or at checkout before you pay. Network fees are paid to the blockchain, not to us, and can change with network demand. Your bank or card issuer may charge its own fees.

You are responsible for reporting and paying any taxes on your crypto transactions, including income tax on gains from virtual digital assets. Where the law requires us to deduct tax at source, such as under section 194S of the Indian Income-tax Act, 1961, we will deduct it and give you the details.

8. Acceptable use

You must not use the Services to:

• launder money, finance terrorism, evade sanctions or commit fraud;
• buy or sell anything illegal, or pay for illegal activity;
• use another person's identity, payment method or account;
• interfere with, scrape, reverse engineer or overload the Services, or try to get around our security or limits; or
• break any law that applies to you or to us.

If we reasonably believe you have broken this section, we may suspend or close your account, refuse orders and report the activity to the authorities as required by law.

9. Intellectual property

The RabitX name, logo, website, app and their content belong to RabitX Technologies Private Limited or its licensors. Product names, photos and descriptions of SafePal and Cryptotag products belong to their owners and are used with permission. You may not copy, modify or reuse any of it without our written consent, except to use the Services as intended.

10. Third-party services

The Services rely on partners such as payment providers, banks, blockchain networks, Cryptorefills and courier companies. We choose them carefully but are not responsible for their own services, downtime or terms. Links to third-party sites are provided for convenience only.

11. Disclaimers and limitation of liability

We provide the Services "as is" and "as available". We do our best to keep them accurate, secure and online, but we do not promise they will be uninterrupted or error-free. We do not give investment, financial, legal or tax advice.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, loss of data, or losses caused by market movements, blockchain network problems, your own mistakes (such as a wrong wallet address) or events outside our reasonable control.

To the extent the law allows, our total liability to you for any claim relating to the Services is limited to the fees you paid us for the transaction or order the claim relates to. Nothing in these Terms limits liability that cannot be limited under Indian law, including your rights under the Consumer Protection Act, 2019.

12. Indemnity

You agree to cover us for losses, claims and reasonable legal costs that arise because you broke these Terms or the law while using the Services.

13. Suspension and closing your account

You can stop using the Services at any time and ask us to close your account by emailing rabitxtech@gmail.com. We may suspend or close your account if you break these Terms, if we are required to by law or a regulator, or if we stop offering a Service. We keep records after closure for as long as the law requires, as described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. If a change is significant, we will tell you by email or in the app before it takes effect. Using the Services after a change means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally. If we cannot resolve it within 30 days, the courts in Chennai, Tamil Nadu have exclusive jurisdiction, without affecting your right as a consumer to approach a Consumer Commission under the Consumer Protection Act, 2019.

We acknowledge every complaint within 48 hours and aim to resolve it within one month of receiving it. Please include your order or transaction ID and any screenshots that help explain the problem.
